1.1 Your access to and use of this site or any Good Better Best Furniture, inc site is subject exclusively to these Terms and Conditions. You will not use the Website for any purpose that is unlawful or prohibited by these Terms and Conditions.   1.  Advice and Returns/Restocking Fees

3.1 No one wants to order the wrong thing, so we make every attempt before an item ships, that it is what you want to purchase.   The contents of Good Better Best Furniture, Inc website do not constitute advice and should not be relied upon in making or refraining from making, any decision.  Some product photos are for illustrative purposes only.  As a customer, you need to read the specifications and determine if the product is suitable for your specific needs.   GBB will generally not ship items unless we make contact to confirm the product selection.  However, GBB is not responsible for purchases you make that don’t fit, have the wrong color, wrong size, don’t match, etc.  We will do all we can to avoid problems, but the responsibility is ultimately upon you, the buyer.  In the rare case a return is required, we reserve the right to charge a 15-35% restocking fee.  Some custom items cannot be cancelled after order is confirmed and cannot be returned.   All returns are returned freight pre-paid. Freight damaged goods or freight loss are treated as described below in section 11.

4.1  change or remove (temporarily or permanently) the Website or any part of it without notice and you confirm that Good Better Best Furniture, Inc shall not be liable to you for any such change or removal.
4.2  GBB can change these Terms and Conditions at any time, and your continued use of the Website following any changes shall be deemed to be your acceptance of such change.

Good Better Best Furniture, Inc Website may include links to third party websites that are controlled and maintained by others. Any link to other websites is not an endorsement of such websites and you acknowledge and agree that we are not responsible for the content or availability of any such sites.

8.1 You agree to indemnify and hold Good Better Best Furniture, inc and its employees and agents harmless from and against all liabilities, legal fees, damages, losses, costs and other expenses in relation to any claims or actions brought against Good Better Best Furniture, inc arising out of any breach by you of these Terms and Conditions or other liabilities arising out of your use of this Website.

  1.  Severance

9.1 If any of these Terms and Conditions should be determined to be invalid, illegal or unenforceable for any reason by any court of competent jurisdiction then such Term or Condition shall be severed and the remaining Terms and Conditions shall survive and remain in full force and effect and continue to be binding and enforceable.

  1.  Governing Law

10.1 These Terms and Conditions shall be governed by and construed in accordance with the law of USA and you hereby submit to the exclusive jurisdiction of the Utah,  USA courts.

  1. Shipping, Lead Times, Freight Damage, Order Cancellations, and Special Services

11.1 All items have different lead times.  Standard lead times can be between 2 days and 8 weeks. All orders, including freight details, are confirmed before payment is accepted, so please inquire and alert your sales rep of any time sensitive orders.  Some items are custom made and extend lead times.  GBB Furniture cannot be responsible for manufacturing delays or delays in shipping beyond their control.  Standard shipping is FOB Factory Or FOB origin via common carrier with tailgate delivery.  If you need that explained, please ask your sales rep.  For more shipping details, click here.

11.2 Other freight or delivery services require advance confirmation and payment via quote.   Inside delivery means items are offloaded and taken inside the main delivery address.  Breaking pallets down, removing pallets and packing materials are separate services. White glove service, where items are moved withing a building, unpacked and dunnage removal are arranged by quote only, before shipment.   Any special services that the consignee has the delivery company do, where there is a charge or billed expense, will be paid by the consignee (customer). 

11.3  Redelivery fees when an appointment is missed will be charged and paid by the consignee.  Delays which accrue storage fees will be paid by the consignee.  Freight companies charge to hold freight.

11.4  Inspection and Damage: Upon delivery, customers must carefully examine the packaging and contents, noting any damage, even if minor, on the shipper’s paperwork when signing for the shipment. Customers should not refuse an order without written approval and must promptly notify GBB of any freight damage. If no damage is documented on the delivery paperwork, processing freight claims may become challenging or even impossible, potentially leading to denial. GBB provides customers with guidelines before delivery, ensuring they are informed and prepared to handle any issues or damaged deliveries. Customers must report damage or loss in a timely manner. If no shipping damage, claim, or loss is reported within 30 days of purchase or payment, the sale and shipment will be considered complete and final.

11.5 Restocking fees.  In the rare case a return is required, we reserve the right to charge a 15-35% restocking fee.  Some custom items cannot be cancelled after order is confirmed and cannot be returned.   All returns are returned freight pre-paid. Freight damaged goods or freight loss are treated as described below in section 11.

11.6  Refunds: Refunds are issued in the most cost-effective manner. Payment platforms such as PayPal and other merchant systems often charge fees regardless of the refund status. As a result, refunds may be processed minus the original order’s payment processing fees.  Refunds may be made to the original payment method or via check or ACH or wire transfer.

  1. Sales tax

USA. Sales tax required by law may be applied to certain sales.  Details will be provided before sales are finalized.  Buyers are responsible for their local sales tax.   Please call if you have questions. 

  1. Pricing Errors

Occasionally, mistakes occur, and corrections might be necessary. If pricing errors are identified before shipping, customers will have the option to either confirm the updated order or cancel it before shipment. GBB will not be held responsible for any damages associated with orders canceled before shipping. 

  1. International: Please call regarding shipments to Canada and other foreign countries. We use our broker to ship to Canada and Mexico.  Other countries are handled individually.
